    • Facts:  A vehicular accident occurred resulting in our client being taken to the hospital.  When the officer arrived on the scene he thought he smelled marijuana and obtained permission to search the vehicle where he located a suspected marijuana cigarette.  Tests confirmed this item to be contraband and our client was charged with driving while impaired. 
    • Defense:  Extensive research into the science of  marijuana's effects on user's ability to drive resulted in locating a weakness in the prosecution's case.  Unlike alcohol the level of marijuana in your system in not closely related to your impairment.  While obviously those partaking in the use of Marijuana should avoid dangerous activities, the mere act of having used marijuana alone should not be enough to convict and it was not here.

    • Description:  Where the Commonwealth's Attorney prosecutes Assault & Battery of a Law Enforcement Officer or Emergency Medical Treatment Provider, the crime of Assault & Battery becomes a Class 6 Felony and carries a mandatory minimum of 6 months incarceration.  We successfully negotiated a misdemeanor in a case where the prosecution could clearly prove their case.  Our client was able to avoid becoming a felony, and nearly as important, was able to keep his employment and provide for his family.
